Eric H. Lipsitt
|
Mr. Lipsitt concentrates his practice in corporate and commercial litigation with particular emphasis on insurance coverage, contract, commercial lending, creditors' rights, bonds and business torts litigation. Mr. Lipsitt has been involved in various types of complex litigation for regional, national and multinational companies in Michigan and across the country. Among such litigation, Mr. Lipsitt has successfully represented a national bank as indenture trustee for bondholders with respect to a multimillion bond issue related to the construction of a de-inking power plant in Michigan. He has represented a national bank in connection with equipment lease disputes with Tier 1 auto suppliers. Mr. Lipsitt has also successfully represented a former executive of a Fortune 500 Company in connection with a claim by a Creditors’ Trust for breach of employment contract and breach of fiduciary duty.
Mr. Lipsitt has specialized in the handling of complex insurance coverage actions including, general liability and product liability, commercial property damage, errors and omissions, fiduciary liability and professional liability. Examples of insurance coverage litigation include representation of a manufacturer in connection with the breast implant insurance coverage action; representation of a large commercial lender with respect to coverage for a multi-million fire loss; representation of an insurer in multi-party litigation against medical providers in connection with the interpretation of the Michigan No-Fault Act; and claims counsel for a captive insurance company.
Mr. Lipsitt also has substantial experience in virtually all aspects of insurance law, including insurance counseling and policy interpretation, the negotiation and settlement of claims, representation of clients in administrative proceedings, development of owner controlled insurance programs, reinsurance disputes, insurance audits, and insolvency matters.
Mr. Lipsitt received his B.A., with high distinction, from the University of Michigan. He obtained his J.D., cum laude, from Wayne State University Law School. Mr. Lipsitt was awarded membership in the National Order of the Barristers and received the Wayne State University Board of Governors Recognition Award.
